DMCA Policy
"The Harvest Movie" ("we", "us", "our") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), Title 17, United States Code, Section 512(c)(3), we have implemented a procedure for receiving copyright infringement notifications and for issuing counter-notifications.
This policy describes the information that should be present in a DMCA takedown notice and how to submit it, as well as the procedure for submitting a counter-notification if your content has been removed due to a mistake or misidentification.
Filing a DMCA Notice of Copyright Infringement
If you are a copyright owner or an agent thereof and believe that any content hosted on "The Harvest Movie" infringes upon your copyrights, you may submit a notification pursuant to the DMCA by providing our Copyright Agent with the following information in writing (see 17 U.S.C. 512(c)(3) for further detail):
- Identification of the copyrighted work claimed to have been infringed: A description of the copyrighted work that you claim has been infringed, or if multiple copyrighted works are covered by a single notification, a representative list of such works.
- Identification of the infringing material: A description of the material that you claim is infringing and where it is located on our website (e.g., direct URL(s) to the specific page or content).
- Contact Information of the Complaining Party: Your full legal name, mailing address, telephone number, and email address.
- Statement of Good Faith Belief: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- Accuracy Statement and Perjury Warning: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Electronic or Physical Signature: An electronic or physical signature of the copyright owner or a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Please send your DMCA notice to our designated Copyright Agent via the contact methods provided on our Contact Us page, clearly marking the subject as "DMCA Notice."
Filing a Counter-Notification
If you believe that your content was removed or disabled as a result of mistake or misidentification, you have the right to file a counter-notification with us. To be effective, a counter-notification must be a written communication provided to our Copyright Agent that includes substantially the following:
- Identification of the Material: Identify the material that has been removed or to which access has been disabled, and the location where the material appeared before it was removed or disabled.
- Statement Under Penalty of Perjury: A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your Contact Information: Your name, address, telephone number, and email address.
- Consent to Jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are outside the U.S., for any judicial district in which "The Harvest Movie" may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
- Electronic or Physical Signature: Your physical or electronic signature.

Be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity was removed or disabled by mistake or misidentification may be subject to liability.
